1. PURPOSE
These General Terms and Conditions of Sale have as their object the purchase of products made remotely via the telematic network on the website http://www.filieforme.eu, hereinafter referred to as Fili e Forme. Each purchase transaction will be governed by the provisions of D. L. n. 185/99 and, as regards the protection of confidentiality, will be subject to the regulations of Law 675/96.
2. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
The Customer, by sending the online confirmation of his purchase order, unconditionally accepts and undertakes to observe in its relations with Fili e Forme, the general conditions and payment transcribed below, declaring to have read and accepted all the information provided to him, in accordance with the above mentioned rules, also noting that Fili e Forme itself is not bound by any conditions other than previously agreed in writing. Fili e Forme considers the contract definitively concluded, except in cases of return or withdrawal, at the time of delivery of the product to the Carrier. Before this time it is crucial the availability of the product and the receipt of money, if you have chosen a payment in advance. Orders sent to Fili e Forme are subject to acceptance and availability of the products. Wires and Forms may decide to cancel your order at any time.
3. CUSTOMER COMMITMENTS
These Terms of Sale must be examined online by the Customers of the Fili e Forme website before confirmation of purchase. The forwarding of the order confirmation therefore implies total knowledge of the Conditions of Sale, and their total acceptance. The Customer undertakes and obliges, once the online purchase procedure is completed, to print and keep these Conditions of Sale, already viewed and accepted during the purchase process carried out, in order to fully meet the condition laid down in Articles. 3 and 4 of D.L. n. 185/1999.
4. PURCHASING ARRANGEMENTS
Fili e Forme is a web site selling noble yarns, pasamanerie and fashion accessories. The purchases of the products, available as they are illustrated and described online in the relevant detailed sheets, is made by the Customer at the price indicated, plus any transport costs, as specified below, and, where applicable, collection costs. The Products are represented and made visible on the Site in an accurate manner and corresponding to the characteristics actually possessed. Wires and Shapes, in any case, is not able to guarantee the exact correspondence to reality in relation to the images and colors as they appear on the Customer’s monitor. Before confirming the order, the Customer will be summarized the unit cost of each product chosen, the total cost in case of purchase of more products and shipping costs. By confirming the order, upon completion of the contract, the Customer will receive an e-mail message containing the Number and Date of the order.
5. PRICE
The prices of the items indicated on the site are inclusive of VAT and are valid for all orders coming from Italy. Prices may be subject to change for any promotions. The price valid for the purposes of the contract is that visible at the time of sending the order.
6. ORDER
The order is completed by means of "point and click" (pressing the button "confirm" and/ or "accept"). If the order is correctly completed, the Customer will immediately receive the confirmation email containing the order number. Otherwise you need to repeat the purchase procedure. With the Order Confirmation, Fili e Forme undertakes to provide the Customer with the Products, the terms and conditions provided in these Conditions of Sale, without prejudice to the right of Fili e Forme not to execute orders against entities that do not provide sufficient guarantees of solvency.
Tips for shopping
Check that you have entered your Data correctly: it is important that the address indicated is easily traceable from the messenger. The Corriere Espresso delivers from Monday to Friday until 17.00 (approximately). In case of absence of the Customer, the Courier will attempt a new delivery, leaving both times a notice of the passage and containing all the indications to contact the Courier. If you do not think you can be present for delivery, you can specify an alternative address during the order process.
Store Stop: you can choose to collect your parcel directly from the branch of the courier used closest to you. Check that you have correctly entered your telephone number, and your e-mail address: if there were problems with the processing or delivery of the order it is important that you can be tracked in order to agree on any changes. In the days following the order, check your e-mail: we may have sent you some communication regarding the order processing. You can check the tracking of your order by connecting to the Fili e Forme website and accessing the area reserved to you. Fili e Forme guarantees the maximum protection of confidential information and sensitive data (see our "Privacy" page). The credit card will be charged in the name of Fili e Forme and will not give information about the nature of the purchases.
7. PAYMENT
The payment of the purchased products and related shipping costs must be made by the Customer:
- when sending the order confirmation, using Paypal or one of the credit cards available and indicated online, or by bank transfer, or by courier at the time of delivery (cash on delivery).
Payments accepted:
Payment via PayPal: Pay safely with your PayPal account or with credit card or postepay. PayPal ensures your purchases with the most used payment system on the internet.
Pagamento mediante Carta di Credito (Visa, MasterCard, PostePay, carte prepagate del circuito VISA) a mezzo Paypal: direttamente on-line, sul Server Sicuro di Paypal senza obbligo di registrazione a Paypal.
Payment by Bank Transfer: you can make the payment by Bank Transfer, upon completion of the order you will find the data to make the payment, take note before leaving the page. Once the payment has been made send us an email of the transfer made (which you will receive from your bank) and indicate the number of your order.
Cash on delivery: you can use cash on delivery, paying your order to the courier at the time of delivery. Cash on delivery payments have an additional cost of 7.50 euros for the costs of collection of the same by the courier.
8. SHIPPING COSTS
The shipping costs for Italy vary from 8.00 to 10.00 euros based on the total weight of the package. The shipping costs for the abroad vary according to the total weight of the package and according to the country of destination. Shipping costs are calculated automatically by the website, you can calculate shipping costs in the appropriate form that you find in the shopping cart.
9. ORDER PROCESSING TIMES
Orders are processed (by processing we mean the delivery of the goods to the freight forwarder) after checking by Fili e Forme on the accuracy of Personal Data and contact details provided by the Customer. Fili e Forme has in stock all the products on the site, therefore all orders will be shipped within 5 working days throughout the national territory. Orders received on Friday are processed starting from the following Monday, with the times described, in relation to the form of payment chosen. The Courier does not deliver on Saturdays, Sundays and holidays, therefore the delivery is postponed to the first day following non-holiday.
Payment by Credit Card or Paypal: within the first working day (from Monday to Friday) following receipt of the order.
Payment by Bank Transfer: on the same day the payment is credited to our account.
Cash on delivery: within 1 working day from receipt of the order.
10. METHODS OF DISPATCH
SHIPMENTS are made by Corriere Espresso for deliveries in Italy. The express courier guarantees delivery in all Italian municipalities and localities, within 48 hours, with the exception of Sicily, Sardinia, Calabria, the smaller islands and areas difficult to access for which delivery is scheduled within 72 hours, from Monday to Friday. You will receive an sms and an email of happened shipment , you can follow the track of the goods directly from the site of the previously selected courier.
11. EXCHANGE OF GOODS
If for any reason the customer is not satisfied with their purchase, the items can be returned for color change/ article, if available. To request authorization to exchange goods, please write an e-mail to office@filieforme.it within 10 days of receiving the package. Reserves the right to refuse unauthorized exchanges. Shipping costs are borne by the Customer.
12. RETURNS
Pursuant to and within the limits of D.L. 185 of 22/05/1999 the Customer is entitled to withdraw from the purchase, if not satisfied, by sending. The return methods and times are the same as indicated in the previous point. The D. L. also provides that essential condition to be able to make use of the Right of Withdrawal is that the goods are returned intact and in the original packaging, and that the cost for shipping costs are borne by the Customer. Pursuant to D.L. 185/99 it is specified that the right of withdrawal is exclusively reserved to Customers defined as "consumers", that is, to natural persons who purchase the products for their own use and act for purposes not related to the professional activity carried out, with the exception of dealers and retailers. Any returns must be agreed and authorized, parcels will not be collected without authorization.
13. REFUNDS
If the Customer, for whatever reason, wishes to return the goods, will be entitled to a refund of the price paid for the product purchased, in the terms and conditions of the Right of Withdrawal. The Customer shall bear the shipping costs. The refund will be made in full, excluding shipping costs, within 30 days by bank transfer to the coordinates indicated by the customer.
14. RULES APPLICABLE TO THE CONTRACT
For everything not expressly provided for and governed by these conditions of sale, the Italian law in force on the matter applies.
15. COMPLAINTS AND GUARANTEES
The products purchased on the Fili e Forme website are subject to the regulations, as far as applicable, of D. L. 2.2.2002 n. 24 (G.U. n. 57, 8.3.2002) on sales contracts and guarantees concerning consumer goods and, although not covered by it, the specific provisions laid down in the Civil Code. This guarantee will apply to the product that presents lack of conformity and/ or malfunctions not found at the time of purchase, provided that the product itself is used correctly and with due diligence and that is in compliance with its destination. The above guarantee will not be applicable in the event of negligence, negligence in the use and maintenance of the product. The guarantee is personal and will therefore apply only to the original buyer, being reserved for direct customers and not to traders, retailers, etc. Any defect of the products must be reported in writing by the customer within the legal deadline at the time of the return of the defective product, which must be previously agreed with Fili e Forme. All returned products will be tested and will be returned at the Customer’s expense if normal operation is found. The request will be processed only if in the returned package will be present the number and date of the order as well as a detailed description of the defect found. The cost of returning the goods to Fili e Forme shall be borne by the Customer. For any clarification and complaints, please contact Customer Service.
16. PRIVACY
Information for those interested in purchasing Fili e Forme products. Fili e Forme, as "Data Controller", guarantees the maximum confidentiality of the Customer’s personal data and full compliance with the obligations provided by Law n. 675/96 and Legislative Decree no. 171/98. Pursuant to art. 10 of Law n. 675/96, laying down provisions to "protect persons and other subjects with regard to the processing of personal data", we inform you that the Customer’s personal data will also be processed with computerised systems and with the help of third parties linked to the company organization, exclusively for purposes related to the execution of the contract. The purposes related to the execution of the contract are, in particular, all the functions connected and instrumental to the execution of the purchase order, such as the management of the computer system, the control of payments, shipment management and complaints management. Fili e Forme, as data controller of the Customer’s personal data, also communicates that a wider information on data processing, the list of rights granted to the Customer pursuant to art. 13 of Law n. 675/96 and the list of subjects appointed by Fili e Forme, data processors, are available upon written request. With reference to the data provided, the Customer may exercise the rights referred to in art. L. 675/96 (access, correction, integration, cancellation, opposition, etc.) by contacting the "Data Controller" or the "Data Processors" of the treatment. By filling in the "Digital Order Form", the Customer declares that he has taken note of this information and expresses his consent to the communication of personal data and the processing thereof, for the purposes and by the subjects indicated in the information itself, aware that in the absence of consent and in the case of established mendacity of the information communicated the order cannot be executed. Fili e Forme guarantees the maximum protection of confidential information and sensitive data, the Customer’s personal data will not be sent to any third party without his prior consent (see our "Privacy" page).
17. DISCLAIMER
Fili e Forme produces in its factories in Florence, and markets the products on the site. Wires and Forms cannot be held responsible for damage caused by improper use of items. The goods and their packaging may be slightly different from the image published on the site. Wires and Forms cannot be held responsible for site malfunctions or service interruptions.
18. COPYRIGHT
The material published on the site cannot be copied, reproduced, republished, downloaded, sent, transmitted in any way without the permission of Fili e Forme.
19. ACCEPTANCE OF THE CONDITIONS
Your use of this site constitutes your acceptance of these terms and conditions, which take effect upon your first use of this site.
